Welcome to htqfoundation.com (the "Website"), operated by Yayasan Halaqah Tadarus Al-Qur’an (HTQ Foundation). By accessing or using this Website and our Services (including Counseling, Courses, Research, and Donation programs), you agree to be bound by these Terms and Conditions ("Terms").
1. Acceptance of Terms and Scope
1.1 Agreement: These Terms apply to all users of the Website and all clients of the services provided by HTQ Foundation.
1.2 Eligibility: You must be at least eighteen (18) years old or have legal guardian consent to use the Services.
1.3 Amendments: HTQ Foundation reserves the right to modify these Terms at any time. Your continued use of the Website and Services constitutes acceptance of the modified Terms.
2. Intellectual Property Rights (IPR)
2.1 Proprietary Content: The Website, its content, the underlying methodologies, and all related materials are the exclusive property of HTQ Foundation and its Founder, Dr. Ziyad Ulhaq.
2.2 Protected Works: This includes, but is not limited to: * The Qur'anic Structure Theory (QST). * Qur'anic Personality Mapping and Archetypes. * Course content, educational curricula (e.g., Abjad Academy materials), reports, articles, names, logos, and trademarks.
2.3 Limited Use: You may access and use the content for personal, non-commercial use only.
2.4 Prohibitions: You shall not reproduce, redistribute, sell, sublicense, modify, or create derivative works from the Foundation's proprietary content or methodologies without express written permission from HTQ Foundation.
3. Services Disclaimer and Limitation of Liability
3.1 Nature of Services (Spiritual Guidance vs. Clinical Advice)

THE SERVICES PROVIDED BY HTQ FOUNDATION ARE NOT A SUBSTITUTE FOR PROFESSIONAL ADVICE.

Qur'anic Guidance: All Counseling, Courses, and Consultations are based on the Qur'anic Structure Theory (QST) and offered as spiritual, personal, and educational guidance (Tarbiyah).

Non-Clinical Service: HTQ Foundation personnel are not licensed medical doctors, psychiatrists, or registered clinical psychologists (unless explicitly stated). The services do not constitute clinical diagnosis, psychiatric treatment, medical advice, or legal advice.

User Responsibility: You are solely responsible for all decisions and actions taken following a session or course. If you have a medical or mental health emergency, you must immediately seek professional medical or psychological help from a licensed provider.
3.2 Limitation of Liability

HTQ Foundation and its personnel (including the Founder) shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising out of your access to, use of, or inability to use the Website or Services, including reliance on any information provided in counseling or courses.
4. E-commerce, Courses, and Refunds
4.1 Course Registration: Enrollment in any course (online or physical) requires full payment of the specified fees.
4.2 Refunds (Courses): * Refund requests must be made in writing. * The Foundation's specific refund policy (e.g., 80% refund if cancelled 7 days before start, no refund after start) will be specified on the course registration page.
4.3 Cancellations (Counseling): Clients must adhere to the Foundation's cancellation and rescheduling policy, which may include a fee for late cancellations (e.g., less than 24 hours notice).
5. Donations and Waqf Programs
5.1 Purpose: Donations made to HTQ Foundation are used to fund the Foundation's mission, including research, operational costs, subsidies for counseling, and the development of the Abjad Academy and Waqf projects.
5.2 Non-Refundable: All donations and contributions to the Waqf Program are final and non-refundable.
5.3 Discretion: While HTQ Foundation strives to allocate funds as designated (e.g., for Waqf), the Foundation retains final discretion over the use of general donations to best meet its charitable objectives in accordance with its statutes as a non-profit organization in Indonesia.
6. User Obligations and Prohibited Conduct
6.1 Lawful Use: You agree to use the Website and Services only for lawful purposes. 6.2 Accuracy: You guarantee that all information you provide to the Foundation (for registration, counseling, or donations) is true, accurate, and complete.
6.3 Prohibited Conduct: You shall not: * Use the Services to distribute hate speech, discriminatory content, or harmful materials. * Attempt to disrupt or interfere with the Website's security or integrity. * Falsely represent your identity or credentials.
7. Governing Law and Dispute Resolution
7.1 Governing Law: These Terms shall be governed by and construed in accordance with the laws of the Republic of Indonesia, without regard to its conflict of law provisions.
7.2 Dispute Resolution: Any dispute, controversy, or claim arising out of or relating to these Terms or the breach, termination, or invalidity thereof shall be settled by amicable negotiation in Jakarta, Indonesia. If a resolution cannot be reached, the dispute shall be submitted to the competent courts in Jakarta, Indonesia.
